Service Terms and Conditions

Website Backups

Carbon Quill Publishing clients are responsible for ensuring they make backups of their own website. We do not backup any websites on our server unless upon request. If you would like us to backup a copy of your website we will create a backup, supply a download link for you to download your website backup and we will then keep a copy of it on or very own dedicated backup hard drive. While server failures are almost never heard of these days we advise all of our clients to create their own backup through their Cpanel control Panel access. If you would like us to manage and create a backup for your website we charge $50.00 for this service. If you have not received access to your hosting Control Panel please Contact Us.

Prohibited Use
Carbon Quill Publishing prohibits the use of its servers for:

* Illegal material, such as commercial audio, video or music files or any other copyrighted works, for which the account holder does not have the permission of the copyright holder, or any other material in violation of Canadian Law
* Adult material, such as pornography, erotic images or otherwise lewd or obscene content
* Racist, defamatory, obscene, indecent or other unlawful material
* ‘Warez’, such as pirated software, ROMS, emulators, instructions or software for phreaking, hacking, password cracking or IP spoofing etc
* Sites engaging in or promoting pyramid sales, Multi Level Marketing or similar activities
* Engaging in illegal activities

Account holders will not post (nor allow to be posted) web or WAP pages containing such material or links to such material, nor shall they store such material in their server space, nor shall they transmit such material by email or any other means.

Carbon Quill Publishing reserves the right to determine whether any material or use is prohibited.

Carbon Quill Publishing reserves the right to remove any such material without warning and suspend or terminate accounts without refund or notice.

Spam (unsolicited email)
Carbon Quill Publishing prohibits spam (the sending of unsolicited bulk email). Carbon Quill Publishing will terminate any account, without refund, for which the account holder has sent unsolicited bulk emails.

Payment for existing Web Hosting Accounts
All web hosting accounts are sold on a one year and/or monthly prepay basis. The full payment for a full year’s service is required at the time of placing your order and any monthly or payments not received within 2 weeks (14 calendar days) of invoice or email notice are subject to suspension/termination at our discretion. These terms are non negotiable. If on a yearly based plan Carbon Quill Publishing will send you a reminder/invoice approx. 4 weeks from your domain name or hosting expiration.

A late charge of $10 will be applied after 1 day from the due date of any late Monthly Payment. If payment is not received by Carbon Quill Publishing within 10 days of the due date, Carbon Quill Publishing has the option of terminating the Client’s Web Hosting Services. These terms are non negotiable.

Carbon Quill Publishing reserves the right, in its sole discretion, to deactivate the Clients Web Hosting account(s) upon an indication of credit problems including delinquent payments. These terms are non negotiable.

*Any website that does not fit in to any of our hosting plans will have one tailor made for them based on calculated space and bandwidth. This calculation will remain in effect and may be modified at any time if more space or bandwidth is needed. Payment for these custom accounts will be reflected on your invoice.

Carbon Quill reserves the right to renew any domain name previously registered by us and not transferred to the client at their request. Any domain name transfer/purchase cost after the termination is at the discretion of Carbon Quill Publishing,. These terms are non negotiable. See Termination Subsection 4 and 5.

Payment can be made via online Paypal or check with the information on your invoice.

Termination

(1) Client may cancel the Web Hosting Services upon the conditions that requests for cancellation must be made in writing with 30 days prior notice and sent to Carbon Quill Publishing. Cancellation will not take effect until received. The used pro-rata time portion of Annual/Monthly Payment that has been made is not refundable unless cancellation is requested in the first thirty (30) days. Setup fees are not refundable. Any websites that have gone over their alloted space/bandwidth will be charged accordingly. Any websites that have not paid for services rendered beyond a 14 day time period are subject to termination.

(2) Carbon Quill Publishing reserves the right to suspend Web Hosting Services without notice for any unpaid or partially paid balances. The Client is responsible for any legal fees incurred for the collection of any unpaid amounts. Carbon Quill Reserves the right to terminate any account at any time for any reason.

(3) The renewal date for accounts will be one calendar year from the date of purchase or the date of previous renewal. Account renewal reminders will be sent by email about one calendar month in advance of renewal date. Payment must be received no later than 14 calendar days prior to renewal date.

(4) Any domain names registered for clients under Carbon Quill Publishing that have an outstanding balance or non payment become the property of Carbon Quill Publishing and may be purchased back after a six (6) month time period. These terms are non negotiable by Carbon Quill Publishing and its domain name registrars. At any time Carbon Quill Publishing may elect to resell any unpaid domain to recoup any losses incurred. Domains registered on behalf of a client/s and not paid after 30 days of registration become property of Carbon Quill Publishing and may be purchased at projected future domain value estimates.

(5) All website content from Suspended/Terminated accounts become the sole property of Carbon Quill Publishing. Source files can be obtained on Compact Disc (CD) via Canada Post mail to the original account owner for a non refundable charge of $200.00. Payment must be made prior to sending of any original source files. Files will be mailed out within 30 days of payment.

(6) Once an account is Terminated/Suspended Carbon Quill Publishing assumes no responsibility for the original website content and it is up to the individual/company/client to obtain their source files in a timely fashion. See Subsection 5.

(7) Failure to pay within any of these time limits will cause suspension of the account or additional fees associated with them.

(8) Failure to pay deposit for contract or commissioned work within 30 days will deem any previous contract null and void. Any domain names purchased or secured under such contract estimate become property of Carbon Quill Publishing and will be subject to the terms and conditions of Subsection 4.

Privacy Policy

Your privacy is important to us. To better protect your privacy we provide this notice explaining our online information practices and the choices you can make about the way your information is collected and used. To make this notice easy to find, we make it available on our homepage and at every point where personally identifiable information may be requested.

The Information We Collect:

This notice applies to all information collected or submitted on the Carbon Quill Publishing website. On our website, you can inquire for services and make requests. The types of personal information collected at these pages are:

Name, Address, Email address, Phone number, (etc.).

We use the information you provide about yourself when placing an inquiry only to complete that inquiry. We do not share this information with outside parties except to the extent necessary to complete that inquiry. We use return email addresses to answer the email we receive. Such addresses are not used for any other purpose and are not shared with outside parties.

Finally, we never use or share the personally identifiable information provided to us online in ways unrelated to the ones described above without also providing you an opportunity to opt-out or otherwise prohibit such unrelated uses.
